Fox Home Online Terms of Sale

Fox Group Canada Inc. (“Fox”, “our”, “we” and “us”) wants to give users of the Fox Home Website (the “Site”) an indulging and soothing service experience, starting from the purchase process on our Site until receipt of their package.

These terms of sale (the “Terms of Sale”) govern purchases made online by users (“you”) on the Site, and are entered into between you and Fox.

Orders

  1. In order to purchase a product through the Site, you must be at least the age of majority in your jurisdiction of residence, and possess and use a valid credit or debit card issued by a bank acceptable to us.
  2. By placing an order on the Site, you are making an offer to buy the selected products from us. All orders must be accepted by us or we will not be obligated to sell such products to you. We may choose not to accept any orders in our sole discretion. Your offer to purchase products on the Site will be considered accepted by us upon the receipt of a confirmation email from us with your order number and details of the products you have ordered.
  3. When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The price charged for a product will be the price in effect at the time the order is placed.
  4. You are required to provide all the relevant information requested via the Site for making any purchase. Please be advised that all information provided must be truthful and accurate. Providing any untruthful or inaccurate information constitutes a breach of these Terms of Sale and may result in cancellation of your order.   
  5. Orders of merchandise placed through the Site are subject to verification and acceptance before shipping. Upon receiving your order, we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.
  6. Prior to accepting an order, Fox reserves the right to request additional information from you in order to validate, among other, the billing information to process your order.
  7. Fox reserves the right to refuse or cancel an order for any reason, including limitations on quantities available for purchase, inaccuracies, errors in billing/payment/shipping information, errors in product or pricing information, problems identified by our credit and fraud prevention department. In the event that your order is canceled after your payment method has been charged, we will issue a credit to your payment method in the amount of the charge.
  8. Fox may refuse to accept any order if fraudulent activity is suspected and may refuse to process subsequent orders from customers with a previous fraudulent order history. In addition, Fox may refuse any orders connected with a previous credit card dispute (or other payment method dispute).
  9. Please be advised that by confirming your purchase, you agree to accept and pay for the item(s) ordered by you.
  10. All orders are subject to availability and confirmation of the order price.
  11. Any stated delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible.
  12. Fox reserves the right, in its sole discretion, to limit the quantity of items purchased per person. These restrictions may apply to orders placed by the same account, the same credit card, and also to orders that use the same billing, email, IP and/or shipping address. We will notify you should such limits be applied. 
  13. Please note that the photos displayed on the site are for illustration purposes and might be differences between the actual item and the image on the Site.
  14. The merchandise sold on our Site is intended for personal use only, not for resale. Any suspected resale of our merchandise for personal or business profit is strictly prohibited. Fox will not accept and reserves the right, at its sole discretion, to cancel orders that appear to be for resale purposes, such as large quantities, frequent orders, orders by dealers or resellers etc. In this case, Fox shall have the right to cancel all subsequent orders from any such customers.
  15. The prices of merchandise posted on the Site may be different from prices available in our stores or through our wholesale partners. Merchandise displayed on the Site may be different from products offered in our retail stores.
  16. The prices displayed on the Site are quoted in Canadian dollars. Posted prices do not include charges for shipping or taxes. All such amounts will be added to your total price at checkout.
  17. Price and availability information are subject to change without notice. In the event that a product is listed at an incorrect price, we shall have the right to refuse or cancel orders placed for the product listed at the incorrect price. 

Limitation of Liability

BY ORDERING ONE OR MORE PRODUCTS AND/OR SERVICES ON THE SITE, YOU ACKNOWLEDGE AND AGREE THAT FOX WILL NOT BE LIABLE FOR ANY DAMAGES, CLAIMS OR CAUSES OF ACTION WHATSOEVER ARISING OUT OF OR RELATED TO SUCH PRODUCTS OR SERVICES.  FOX PROVIDES SUCH PRODUCTS AND SERVICES ON AN “AS IS” BASIS WITHOUT REPRESENTATIONS OR WARRANTIES OR CONDITIONS OF ANY KIND AND WE DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESSED OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT OR ABSENCE OF HIDDEN DEFECTS. THIS LIMITATION OF LIABILITY APPLIES TO DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE OR OTHER DAMAGES YOU OR OTHERS MAY SUFFER, AS WELL AS DAMAGES FOR LOST PROFITS, BUSINESS INTERRUPTION OR THE LOSS OF DATA OR INFORMATION. Fox’s liability in connection with any product sold to you shall not exceed the amount paid by you for such product.

Shipping Area

  1. We currently ship only to addresses located in the Provinces of Ontario.

Shipping Schedule:

  1. The package will be shipped within up to 5 business days from the date on which you received the confirmation of your order.
  2. Once your order has been shipped, we will provide you with a tracking number via email .You can use this tracking number on the shipping carrier's website to monitor the progress of your shipment or contacting our customer service at customerservice@fox-canada.com.

Delivery Options

  1. All of our shipments are sent by courier Canada Post, at our discretion, to an address of your choosing.

         Charges shown below are based on the total value of merchandise shipped to each address.

          All shipping charges include handling, order processing, item selection, packaging and  transportation of items.

 Returns and Exchanges:

  1. Within 30 days of receiving the order, purchases made online can be exchanged for another product for the same price, or returned to a Fox Home store and the amount of the purchase will be refunded to the original method of payment listed on the receipt within several days after the purchase has been returned. As an exception to the above, products "on sale" can be exchanged or returned, as described above, only within 14 days of receiving the order.. Refunds can't be made by store credits.
  2. Purchases of "Clearance Items" can't be exchanged or returned.
  3. In order to return or exchange a product, it must be unused/unworn, in original condition and in its original package.
  4. Exchanging products purchased on our Site or returning them can only be made in Fox Home Stores in Canada.
  5. Shipping charges will not be returned in any case.

 

 Order Cancellation by Fox

  1. Your order might not be processed if the product you selected is out of stock after placing the order or if the credit card details and/or personal details provided by you were not properly registered in the system. In each of the above cases, our customer service team will contact you.
